Legal information for Clients

The following "Terms and Conditions" details the relationship between Kavin Windsor & Justine Windsor (Referred to as 'The Deliverers'), and the Owner, regarding delivery of yachts and power vessels.

TERMS & CONDITIONS

1. The owner of the vessel is to ensure that,

a. The vessel is adequately insured for loss or damage, and that the insurance is current.
b. The vessel is in a seaworthy condition, such that it is capable of the delivery passage, given all reasonable and forseeable events.
c. A marine surveyor's report is available on request, if there are doubts as to the vessel's seaworthiness.
d. All safety equipment is present, serviceable and within inspection date, and that such safety equipment is adequate for the planned passage and shall comply with the relevent legislation within the state or territory, or shall comply with the YA recommendations, whichever is the greater.
e. Any repairs or alterations be undertaken to the satisfaction of the deliverers prior to departure on the delivery passage.

QUOTES & ESTIMATES.

1. All quotes and estimates supplied by Kavin Windsor are valid for thirty (30) days, and are based on the fee structure laid out on the FEES page of the website.
2. Quotes do not include the following items, which will be at the owner's expense:
  a.Transport of the deliverers from their home port to the vessel.
  b. Transport of the deliverers from the destination to the deliverers home port. Transport shall be agreed upon between the owner and the deliverers before departure.
3. All quotes are subject to variation where the deliverers are required to purchase fuel or organise repairs during the passage. Receipts for fuel and repairs will be available to the owner.

CANCELLATIONS.

1. Cancellations of deliveries, at no cost, may be made by either party prior to the commencement of the passage.
2. Cancellation of the delivery may also be made by the deliverers, during the passage, if in their opinion, the vessel is, or becomes, unfit for the passage being undertaken. In such an event, the vessel will be berthed at the closest available port and the owner informed.
3. The owner will be invoiced for any portion of the passage completed, and for the transport of the deliverers to their home port. Payment is to be made in full within seven (7) days.

PAYMENT TERMS.

1. Payments should be made by cheque, made out to "Kavin Windsor", or by cash. Orders made by overseas customers must be paid in Australian dollars by bank draft or telegraphic transfer.
 
2. Receipts will not be issued on payment of invoices unless specifically requested by the client.
 
3. All prices quoted are inclusive of GST for Australian Residents. 

ACCEPTANCE OF TERMS AND CONDITIONS.

Before Deliveries will commence, the client must sign an agreement outlining the proposed work and confirming their acceptance of these Terms & Conditions.

ALTERATIONS TO TERMS AND CONDITIONS.

Kavin Windsor reserves the right to change, at any time, these Terms and Conditions.
